Plans to Burn Qur’ans (Koran) Illegal. Rev. Jones should be arrested for conspiracy.

The crime of conspiracy is committed when two or more people plan a criminal act for some time in the future. The reverend Terry Jones, of the Dove World Outreach Center, has publicly announced “Burn the Koran Day” on September 11, 2010. Since the Gainesville, FL fire dept has denied a permit to burn the books, his continued plan to burn the religious books, along with his congregation, should be considered a conspiracy.

 Terry Jones should be arrested and charged with conspiracy to commit an illegal act. The police should wait until just before the planned burning so that Jones won’t have time to raise bail.

 The Gainesville municipal codes allow for cooking meat in outdoor fire pits. Refuse is not allowed, however.

 FLORIDA’S PINCIPALS, CONSPIRACY, AND ATTEMPT LAWS

777.011 Principal in first degree.

Whoever commits any criminal offense against the state, whether felony or misdemeanor, or aids, abets, counsels, hires, or otherwise procures such offense to be committed, and such offense is committed or is attempted to be committed, is a principal in the first degree and may be charged, convicted, and punished as such, whether he or she is or is not actually or constructively present at the commission of such offense.

 777.04 Attempts, solicitation, and conspiracy.

 (3) A person who agrees, conspires, combines, or confederates with another person or persons to commit any offense commits the offense of criminal conspiracy, ranked for purposes of sentencing as provided in subsection (4).

 “Conspiracy generally is an agreement of two or more people to commit a crime. The most commonly prosecuted conspiracy crime in Florida and Georgia is conspiracy to distribute drugs, i.e. cocaine, marijuana, methamphetamines, ecstasy, oxycodone, or other similar types of drugs. A conspiracy does not need to have been planned in secret, does not require proof of specific intent by the defendants to injure any specific person to establish an illegal agreement. Instead, the conspirators need only to have agreed to engage in a certain illegal act in Florida.”

    Hey Rose
    Is the county under a burn ban? If not, how can the Holy Book Roast be determined to be ‘criminal” or illegal in nature?
    Is the man “Christian”? I don’t think so….nor is this what I would consider a Christian act….
    Though an INSULT of the worst sort, it is an expression of Freedom of Speech, no different than burning the US flag or burning your bra.
    I blame the Media and our fearless elected leadership for this propaganda spew, it is THEY who are dramatizing this outrage of sensibilities.

    yes, lisa, they are under a burn ban. It is prohibited to burn paper. So, yes it will be an illegal act if they go through with it. So like I state, to plan the burning should be considered “a conspiracy.”

    Where’s the link showing they are under a burn ban? I know my county is under one from not having rain for 2 mths and they usually post that info in the courthouse.
    If under a burn ban, in that case, sounds like He and his “friends in outrage” would be committing a willful act to violate county CODE enforcement, which could result in a fine/jail or both—and more like a misdemeanor IMO.

    A man who lives a few miles from me was burning leaves and accidentally caught HIS OWN woods on fire—not bad, but the call was made to the fire station—guess what? The county law shows up and arrests him for ARSON!!! Unbelievable—no burn ban and it was his OWN property that was damaged. Go figure huh?

    It’s increasingly looking as though the only spiritual or political figure who will not denounce Florida pastor Terry Jones’ plan to commemorate Sept. 11 by burning copies of the Quran is Jones himself. Wednesday brings the news that even the church Jones founded in Germany in the 1980s is condemning the upcoming Quran-burning at his small place of worship in Gainesville, Fla.

    “We are surprised and shocked at the extreme radicalism being displayed [by Jones] right now on this issue,” Stephan Baar of the Christian Community of Cologne told the Associated Press. The 60-member church kicked out Jones in 2008. Jones’ estranged daughter says the eviction arose from her father’s reported penchant for dipping into the church’s till to pay his own expenses.

    Well Rose, this shows CITY but nothing about “County” burn bans?
    Is the Holy Book Roast inside city limits, if so, looks like you are 100% correct he must have a permit.
    Wonder if this could be considered a ‘campfire”? lol…..come one, come all, bring your own wienies and marshmallows to roast! BYOW and BYOM…heeeee

    Sec. 10-70. – Burning permits.

    (a)

    Except for burns conducted pursuant to valid authorization under F.S. Ch. 590 and Rule 5I-2, Florida Administrative Code, no person shall start or maintain any outdoor burning or open burning regulated under this article without a burning permit issued by the risk reduction bureau of the city fire rescue.

    (b)

    Any person responsible for residential or commercial burning leaves, brush, clean wood or other vegetative debris under section 10-64 of this article shall obtain a one-time burning permit before starting the fire. The fee for each one-time burning permit shall be as set out in Appendix A, Schedule of Fees, Rates and Charges.

    (c)

    An outdoor campfire does not require a permit provided that the fire complies with all other applicable provisions of this article.

    (d)

    The owner or occupant of the property shall obtain a burning permit for each burn barrel and/or outdoor wood-fired boiler before using the burn barrel and/or outdoor wood-fired boiler. The fee for each annual burning permit shall be as set out in Appendix A, Schedule of Fees, Rates and Charges.

    (e)

    When weather conditions warrant, the fire chief or his designee may temporarily suspend issuing burning permits and may temporarily suspend previously issued burning permits for open and outdoor burning.

    (f)

    A burning permit issued under this section shall require compliance with all applicable provisions of this article and any additional special restrictions deemed necessary to protect public health and safety.

    (g)

    Any violation of the conditions of a burning permit shall be deemed a violation of this article. Any violation of this article or the burning permit shall void the permit.

    (1)

    Any person who is notified that a burning permit has been voided may within five business days request a review by the fire chief, or designee, and present any information which demonstrates that this article or the terms of the permit were not violated.

    (2)

    The fire chief, or designee, shall send notice of the determination by regular U.S. mail within three business days as to whether the voided permit has been reinstated.

    Sec. 10-63. – General prohibition on outdoor burning and open burning.

    Open burning and outdoor burning are prohibited in the City of Gainesville unless otherwise specifically permitted as provided by this article.

    (a)
    Open burning of refuse. Open burning of the following materials is prohibited.

    (1)
    Construction and demolition waste.

    (2)
    Hazardous substances including but not limited to batteries, household chemicals, pesticides, used oil, gasoline, paints, varnishes, and solvents.

    (3)
    Furniture and appliances.

    (4)
    Tires.

    (5)
    Any plastic materials including but not limited to nylon, PVC, ABS, polystyrene or urethane foam, and synthetic fabrics, plastic films and plastic containers.

    (6)
    Newspaper.

    (7)
    Corrugated cardboard, container board, office paper.

    (8)
    Treated or painted wood including but not limited to plywood, composite wood products or other wood products that are painted, varnished or treated with preservatives.

    I would think newspaper/cardboard/office paper/ and such products to be INCLUDED in the burn ban…..maybe they need to re-write the code and just plainly and simply state ALL paper and cardboard type products, including but not limited to bound books.
    But who would’va thought to include Burning BOOKS until NOW? Zionism aka Nazism is here for certain.

    Well honey, if he or any other fool does this outrage, start stocking up on necessities for survival….cause WWIII and a “Pre-meditated” attack on Iran won’t be far behind it I fear.
